The only condition for the justification of the Supreme Court decision in AG Adamawa State & ors. V AGF & ors. is that on the day it was delivered, the 1999 Constitution of the Federal Republic of Nigeria did not exist and had no binding force on the decision of that Supreme Sanhendrin.
